“Thus, we are of the opinion that prompt dower is
payable on demand during the subsistence of the marriage tie
whereas the deferred dower is payable on the time stipulated
between the parties, but where no time is stipulated, it is
payable on dissolution of marriage either by death or divorce.
But, the deferred dower does not become “prompt” merely
because the wife has demanded it. In the instant case, the total
amount of dower was fixed at Rs.10,00,000/-. The prompt
dower is to the tune of Rs.5,00,000/- was paid at the time of
marriage in the shape of golden ornaments, etc. Since no time
was fixed for payment of the deferred dower of Rs.5,00,000/-, it
would be payable in the eventuality of dissolution of marriage
either by death or divorce”.
