14. Similarly in Benedict F.D. Souza v. Karachi Building
Control Authority and 3 others (1989 SCMR 918) it was
observed that;
"Factual controversies involved in the case, could
not be solved without a full-fledged trial.
Accordingly we find that the approach of the High
Court in its discretionary writ jurisdiction to
decline relief to the petitioner, was
unexceptionable. No justification has been made
out for grant of leave to appeal. The same is
refused."
