Respectfully Sheweth:-
1. That the brief facts of the case are that the respondent No:-3 filed an Application u/s *00* of Guardian & Wards Act, 1876 before respondent No:-00- for the custody of minors namely (Name) aged about *(digit)* year and [Name...] aged about 4 years. Thereafter the petitioner filed written reply to the said application and after consider the evidence of both sides, the respondent No:-00- dismissed the application of respondent No:-3 vide order dated [dd-mm-yyyy]. Attested copy of petition and order & decree dated [dd-mm-yyyy] is attached herewith as ANNEXED (ATTACHED)-A&B respectively.
2. That being aggrieved from the order dated [dd-mm-yyyy] passed by the respondent No:-00-, the respondent No:-3 filed an appeal before respondent No:-*00*. Attested copy of appeal is attached herewith as ANNEX-C. and the same was allowed by the respondent No:-*00* vide judgment & decree dated [dd-mm-yyyy]. Copy of the judgment & decree dated [dd-mm-yyyy] is attached herewith as ANNEX-D.
3. That the judgments & decrees of the respondent No:-*00* is suffer from great illegality and the petitioner seeks remedy on the following amongst other;-
GROUNDS
قانون اور حقائق سے ہٹ کر حکم کرنا
a. That the impugned Judgment has been passed by respondents No:-*00* is against the law and facts of the case, therefore liable to be modified.
شہادت کا درست طور پر زیرغور نہ لایا جانا
b. That the finding of the Learned Court below is erroneously and result of misreading and Non~reading of evidence.
شہادت کو نظر انداز کردینا
c. That the respondent No:-*00* has ignored the evidence as produced by the petitioner.
طلاق کے باوجود کسٹڈی میں کوئی قانونی قدغن نہیں
d. That the second husband of the petitioner (Name ..) has divorced her and there is no legal bar about the custody of the minors remains with the petitioner.
بچوں کی فلاح و بہبود ممتاز اصول
e. That the preliminarily consideration of the Court should be the welfare of the minor, but the Learned Appellate Court (Adalat-e-Murafiya) totally ignored this aspect of the case while deciding the appeal of the respondent No:-3.
زرکفالت سے بچنے کی خاطر اپیل وغیرہ
f. That the respondent No:-3 filed the application and appeal just to safe himself for the Maintenance Allowance (Zar-e-Kafalat) of the minors.
ماں ایک بہترین گود ہوتی ہے بچوں کی پرورش کی خاطر
g. That the petitioner is the real mother of the minors and is natural guardian of the minors and it is necessary for the welfare of the minors that the custody be remains with the petitioner.
والدہ سے بڑھ کر بچوں کی دیکھ بھال کوئی نہیں کرسکتا
h. That the petitioner can look after the minor better then the respondent No:-3.
بچوں کی بنیادی ضروریات والد پوری کرنے سے قاصر
i. That the respondent No:-3 is unable to properly look after the minors and give them basic necessary of life and good education.
والد کے گھر والے کچھ پیدائشی بیماریوں کا شکار
j. That the respondent No:-3 admitted in his evidence that his mother is blind and his sister is disabled, therefore he has no sources to look-after the minors properly.
ایک نوکر کو اگر بچے دیے گئے، وہ بھی ان کو نوکروں جیسا بنا دےگا
k. That the respondent No:-3 is a servant of landlord and if the custody of the minors handed-over to the respondent No:-3 he will make the minors the servant of the said landlord.
ناقابل تلافی نقصان
l. That if the custody of the minors handed over to the respondent No:-3, the petitioner shall suffer an irreparable loss and injury.
کوئی دیگرے موثر دادرسی کا نہ ہونا
4. That there is no other efficacious alternative and speedy remedy except to invoke the constitutional jurisdiction of this Honourable Court.
PRAYER
It is therefore, respectfully prayed that this writ petition may graciously be allowed and impugned judgment & decree dated [dd-mm-yyyy] passed by respondent No:-*00* may kindly be set-aside while restoring the judgment & decree dated [dd-mm-yyyy] passed by respondent No:-00-, in the interest of justice and fair play.
It is further prayed that till the final decision of the instant writ petition the operation of the impugned judgment & decree dated [dd-mm-yyyy] may kindly be suspended.
Any other writ, relief or direction expedient in the interest of justice may also be issued in vindication of the grievances afore-referred.
