جہاں ادائیگی کے مخصوص وقت کے حوالے کے بغیر فوری یا موخر ڈیوور کی شرط نکہ نامہ میں مذکور ہے ، مسلم فیملی لا آرڈیننس ، 1961 کے سیکشن 10 میں موجود قانونی اصول کے پیش نظر ، فوری یا موخر ڈیوور ، جیسا بھی معاملہ ہو ، مطالبہ پر قابل ادائیگی ہوگا ۔ اس کے برعکس ، جہاں 'ڈیفرڈ ڈوور' کا اظہار نکہنامہ میں کسی مخصوص تاریخ کو یا موت یا طلاق پر اس کی ادائیگی کے لیے مخصوص شرط کے ساتھ درج ہے ، اسی کے مطابق ادائیگی کی جائے گی ۔
Where stipulation of prompt or deferred dower without any reference to specific time of payment is mentioned in the Nikahnama, prompt or deferred dower, as the case may be, shall be payable on demand in view of statutory rule contained in Section 10 of the Muslim Family Laws Ordinance, 1961. Conversely, where the expression deferred dower is listed in the Nikahnama with specific stipulation for its payment on a specific date or upon death or divorce, the same will be paid accordingly.

In a suit for dissolution of marriage, the court is required to make proper efforts to reconcile the matter in terms Section 10(3) of the Family Court Act, 1964 and on failure of reconciliation proceedings is empowered to pass a decree for dissolution of marriage but said Section does not provide that in every case, where reconciliation proceedings are declared as not successful, the decree for dissolution of marriage on basis of Khula is definitely to be passed, rather the Court has to assess whether wife through her voluntary decision really requires marriage to be dissolved or not.

When a Family Court does not give adequate opportunity to file a written statement, an additional chance should be granted. It emphasized that speeding up a case should not lead to rushed decisions without proper judicial consideration. Courts must ensure that any decision made for the sake of expediency does not cause injustice or prejudice. In doing so, they must balance the principles that "justice delayed is justice denied" and "justice hurried is justice buried".

Family disputes---Writ of certiorari---Scope---High Court can issue an order of certiorari to rectify jurisdictional errors committed by subordinate Courts in family law matters---Such errors can arise when Family Courts or First Appellate Courts issue decisions without jurisdiction, in excess of jurisdiction, or fail to exercise their jurisdiction altogether---Certiorari order is applicable when Family Court or First Appellate Court acts in an illegal or improper manner while exercising its jurisdiction---This includes situations where Court makes determinations without providing an affected party opportunity to be heard or where procedural methods employed contravene fundamental principles of natural justice---It is crucial to recognize that High Court's jurisdiction to issue certiorari is fundamentally supervisory, meaning, it does not possess authority to function as an appellate body---Such supervisory role imposes clear limitations: specifically, it prohibits High Court from reevaluating or questioning factual findings made by subordinate Courts based on their assessment of evidence---High Court does not engage in reviewing or re-weighing evidence that underlies decisions made by Family Court or First Appellate Court---Instead, it may only nullify a decision it finds to be beyond jurisdiction or grossly erroneous without imposing its own conclusions in place of those reached by lower Courts---Certiorari orders can be granted solely when a clear error of law is evident on the face of record; however, this does not extend to addressing errors of fact, regardless of their severity.
