 No doubt Section 11(3) of theFamily Court Act provides that the parties or their counsels may further examine, crossexamine or re-examine the witnesses, however, it has been held by the Hon’ble Supreme Court of Pakistan that such provisions are not meant and designed for enabling a party to fill up the omissions in the evidence of witness who has already been examined, due to negligence and lapse of a party, rather the purpose, the nature and the scope of the power available to the Court in that regard is to enable it to seek clarification on any issue or to have a doubt cleared in the statement of a witness which if left outstanding and without which it would be difficult for the Court to take a right decision.

The principle of equality of arms, which is a judicial construct adopted by the European Court of Human Rights, means giving each party a reasonable possibility to present its cause in such conditions as would not put one party in disadvantage to its opponent. In other words, there must be a fair balance between the opportunities afforded to the parties involved in litigation.
Proper opportunity having already provided to the petitioner to cross-examine PWs, to allow another opportunity to the petitioner to cross-examine any witness to fill up lacuna would be akin to place the petitioner at a comparative advantage over his opponent, which would be contrary to the principle of equality of arms and result in violation of Article 10A of the Constitution, therefore, the same could not be allowed.

سپریم کورٹ نے قرار دیا ہے کہ بیوی ذہنی یا جسمانی ظلم کی بنیاد پر شوہر سے تنسیخ نکاح کا دعویٰ دائر کرنے کا حق رکھتی ہے۔
جسٹس سردار طارق مسعود کی سربراہی میں جسٹس امین الدین خان اور جسٹس محمد علی مظہر پر مشتمل سپریم کورٹ کے تین رکنی بینچ نے یہ فیصلہ تنسیخ نکاح سے متعلق پشاور ہائی کورٹ کے فیصلے کے خلاف اپیل منظور کرتے ہوئے دیا۔
یہ فیصلہ جسٹس محمد علی مظہر نے تحریر کیا ہے جس میں ’قانونِ محمدی‘ کا حوالہ دے کر کہا گیا ہے کہ ’اگر بیوی پر سسرال میں ظلم ہو رہا ہو اور وہ خاوند کے گھر میں غیر محفوظ ہو تو وہ تنسیخ نکاح کا دعویٰ دائر کر سکتی ہے۔‘
عدالت نے تشدد کی بنیاد پر تنسیخ نکاح کو خلع کے ذریعے شادی کے خاتمے میں تبدیل کرنے کے اپیلیٹ کورٹ اور پشاور ہائی کورٹ کے فیصلے کو کالعدم قرار دیتے ہوئے فیملی کورٹ کے فیصلے کو بحال کیا ہے۔
فیصلے میں قرار دیا گیا ہے کہ ’مرد اور عورت کے درمیان ازدواجی بندھن پاکیزہ رشتہ ہے جو زندگی میں اہم کردار ادا کرتا ہے اور یہ رشتہ میاں بیوی کے درمیان ایک دوسرے کی خوشی اور ہمدردی کے جذبات کو پروان چڑھاتا ہے اور اس پر ہی خاندانی نسب اور وراثت کا بھی انحصار ہوتا ہے۔‘
فیصلے میں کہا گیا ہے کہ ’ازدواجی رشتہ نرمی، انسانی اور جذباتی وابستگی کی بنیاد پر قائم ہوتا ہے جس کے لیے باہمی اعتماد، احترام، وقار، محبت اور پیار کی ضرورت ہوتی ہے اور اس لیے یہ اہم رشتہ معاشرتی اصولوں کے مطابق ہونا چاہیے جیسا کہ دینِ اسلام شوہر کو خوراک، لباس، رہائش اور دیگر تمام ضروریات زندگی فراہم کرنے کا حکم دیتا ہے، اسی طرح مرد سے توقع کی جاتی ہے کہ وہ اپنی بیوی کے ساتھ پیار اور محبت کے ساتھ اچھا سلوک روا رکھے گا۔‘
معاملہ شروع کب ہوا تھا؟
فیصلے میں کہا گیا ہے کہ ’ایسا طرزِ عمل یا رویہ جو بیوی کے لیے ذہنی اذیت اور جسمانی تکلیف کا باعث بنتا ہے اس کے لیے ازدواجی بندھن کو برقرار رکھنا ناممکن بنا دیتا ہے تو وہ تنسیخ نکاح کے دعوے کی حق دار ہے۔‘
واضح رہے کہ پشاور کی رہائشی ایک خاتون نے سنہ 2014 میں اپنے شوہر کے ناروا سلوک کی بنیاد پر تنسیخ نکاح اور حق مہر کی ادائیگی کا دعویٰ دائر کیا تھا۔
فیملی کورٹ نے دعویٰ منظور کیا جبکہ اپیلیٹ کورٹ نے فیصلے کے خلاف اپیل جزوی طور پر منظور کر کے ناروا سلوک کی بنیاد پر تنسیخ نکاح کو خلع میں تبدیل کر دیا اور بیوی کو حق مہر کا پانچ تولہ سونا یا مارکیٹ ریٹ کے مطابق مساوی رقم شوہر کو واپس کرنے کا حکم دیا تھا۔
پشاور ہائی کورٹ نے فیصلے کے خلاف اپیل مسترد کر دی تھی۔
تاہم اب سپریم کورٹ نے ہائی کورٹ اور اپیلیٹ کورٹ کا فیصلہ کالعدم کر کے فیملی کورٹ کا فیصلہ بحال کر دیا اور قرار دیا ہے کہ ’شوہر کا بیوی کے دعوے کے جواب میں ازدواجی حقوق پورے نہ کرنے کا مؤقف مہر کی ادائیگی سے بچنے کا محرک ہو سکتا ہے۔‘
فیصلے میں مزید کیا کہا گیا ہے؟
فیصلے میں کہا گیا ہے کہ ’فریقین کے درمیان بنیادی اختلاف کے سبب یہ سوال تھا کہ کیا درخواست گزار طیبہ عنبرین ظلم کی بنیاد پر شادی ختم کرنے کے حکم نامے کا دعویٰ کرنے کی مستحق تھی اور کیا اپیلیٹ فورم نے ظلم کی بنیاد پر نکاح کو ختم کرنے کے بجائے خلع کے ذریعے ختم کر کے ٹھیک فیصلہ کیا؟‘
سپریم کورٹ اپنے فیصلے میں قرار دیا کہ ’بے رحمانہ، ظالمانہ اور جابرانہ طرزِ عمل اور رویے کے باوجود شوہر کی جانب سے ازدواجی حقوق کے دعوے کا واحد اور بنیادی مقصد صرف اور صرف کفالت اور مہر کی رقم کی ادائیگی سے بچنا معلوم ہوتا ہے۔
’مدعا علیہ کی یہ کوشش اس وقت کامیاب ہوئی جب اپیلیٹ کورٹ نے بیوی کو مہر کی رقم واپس کرنے کی ہدایت کرنے کے ساتھ خلع کے ذریعے شادی ختم کرنے کا فیصلہ جاری کیا۔‘
فیصلے میں کہا گیا ہے کہ ’فیملی کورٹ نے واضح اور غیر مبہم انداز میں کہا کہ درخواست گزار خاتون نے کئی واقعات کا حوالہ دے کر شوہر کی جانب سے ان پر کیے جانے والے ظلم کو ثابت کیا جبکہ جرح کے دوران بھی خاتون کی جانب سے پیش کیے گئے شواہد کو جھٹلایا نہیں گیا۔ لہٰذا فیملی کورٹ نے مکمل جانچ پڑتال اور شواہد پر غور کرنے کے بعد ظلم کو بنیاد بناتے ہوئے شادی کو ختم کیا۔‘
سپریم کورٹ کے فیصلے میں ان واقعات کا بھی حوالہ دیا کہ فیملی کورٹ کے فیصلے میں کس طرح مختلف حالات و واقعات کی عکاسی کی گئی جو بیوی کے لیے ذہنی اذیت اور تشدد کا باعث بنے جیسا کہ یہ بات کہ شادی کے صرف ایک ہفتے بعد ہی شوہر نے بیوی پر دباؤ ڈالنا شروع کر دیا کہ وہ کرائے پر مکان حاصل کرنے کے لیے رقم کا بندوبست کرے۔
عدالت نے نوٹ کیا کہ ’شوہر اور اس کے خاندان کے افراد نے بھی خاتون پر جھوٹے الزامات لگائے جس میں یہ الزام بھی تھا کہ درخواست گزار کے بطن سے پیدا ہونے والی بچی مدعا علیہ کی بیٹی نہیں اور اس طرح کی الزامات کے باعث درخواست گزار کو شدید ذہنی اذیت کا سامنا کرنا پڑا۔‘
عدالت نے اپنے فیصلے میں اس بات کا بھی ذکر کیا ہے کہ اس کے علاوہ شوہر اور اس کے خاندان کے افراد نے خاتون پر ’یہ سخت شرط عائد کی کہ وہ اپنی تنخواہ شوہر کے ساتھ جوائنٹ اکاؤنٹ میں جمع کرائے اور ذاتی استعمال کے لیے رقم اس کی اجازت سے لے۔‘
سپریم کورٹ نے اپنے فیصلے میں یہ بھی کہا کہ ’عدالت میں کیس دائر کرنے کے باوجود شوہر کے رویے میں کوئی تبدیلی نہیں آئی بلکہ اس نے اپنی بیوی کو مزید ذہنی اذیت میں مبتلا کر دیا اور اس پر مزید جھوٹے الزامات لگانا شروع کر دیے۔‘
سپریم کورٹ نے اپنے فیصلے میں کہا کہ ’اپیلیٹ کورٹ نے ثبوتوں پر غور کرنے کے بجائے بغیر کسی وجہ کے قرار دیا کہ جسمانی تکلیف یا ذہنی اذیت کو ظاہر کرنے کے لیے ٹھوس ثبوت پیش نہیں کیے گئے۔‘
The dissolution of marriage on the ground of cruelty, the Court must adjudge the intensity and ruthlessness of the acts and examine whether the conduct complained of is not merely a trivial issue which may happen in day-to-day married life, but is of such a nature which no reasonable person can endure. While claiming conjugal rights by a husband in response to the suit for dissolution of marriage, dower, dowry and maintenance, it is also an onerous responsibility of the Court to see whether he is sincerely fulfilling his obligations towards his wife.

Judgment

Through this single judgment, this Court intends to decide the titled petition as well as Writ Petition No.2682 of 2018 filed by the Respondents as both the petitions have been filed against the same judgments and decrees.
2. For the sake of clarity, Zia Hussain is to be referred as (the “Petitioner”, whereas, Mst. Asma Saleem and others are to be referred as (the “Respondents”).
3. The Petitioner has called in question judgments and decrees of the Family Court as well as Appellate Court, dated 25.04.2018 and 01.09.2018, respectively, whereby maintenance allowance in favour of the Respondents has been fixed on higher side. Writ Petition No.2832 of 2018 has been filed by the Petitioner for reduction of the maintenance allowance. On the contrary, the Respondents through W.P.No.2682 of 2018 have assailed the judgments and decrees of the Courts below for enhancement of their maintenance allowance.

The facts of the case are that the marriage of Petitioner and the Respondent No.3 was solemnized on 27.11.2003 and they were blessed with two children namely Muhammad Moazam Zia and Abdul Rafay (hereinafter to be referred as “minors”). Due to strained relations between the spouses, the Respondents filed a suit for dissolution of marriage on the basis of khulla, recovery of maintenance allowance and dowry articles. The said suit was contested by the Petitioner by filing written statement, however, the suit was decreed to the tune of Rs.10,000/- per month for each minor from January, 2016 along with 10% annual increase till their age of majority. Mst. Asma Saleem, was held entitled to recover Rs.30,000/- lumpsum only for iddat period while she was also granted dowry articles as per list Ex.P3 except articles mentioned at Sr. Nos. 9, 12 to 14, 17, 18, 23 to 28, 30, 33, 35 and 36 or alternate price Rs.2,00,000/-. Feeling aggrieved thereof, both the parties preferred their respective appeals, however, appeal of the Respondents was partially accepted with modification while that of the Petitioner was dismissed in the following manner:
“In the light of above discussion, appeal of the appellants is accepted partially whereas appeal of the Respondents dismissed and the impugned judgment and decree is modified to the effect that plaintiffs No.2 and 3 shall be entitled to maintenance allowance at the rate of Rs.15,000/- per month from February, 2015 with 10% increase per annum till their legal entitlement whereas impugned judgment and decree to the extent of maintenance allowance of plaintiff No.1 and dowry articles is upheld”.

Learned counsel for the Petitioner inter alia contends that impugned judgments and decrees are the result of mis-reading and non-reading of material available on record; that the learned Trial Court wrongly assumed the financial status of the parties and prices of the dowry articles, therefore, confirmation, as well as, enhancement by the learned Appellate Court has been made under a wrong impression; that the maintenance allowance fixed by the Courts below is also exaggerative and has been awarded without looking into financial status of the Petitioner; that no proof of income of the Petitioner was tendered by Respondents and in absence thereof, fixation of maintenance allowance by the learned Courts below is against the norms of justice.

Conversely, learned counsel for Respondents contended that though the learned Appellate Court has modified the judgment and decree passed by the learned trial Court and increased the amount of maintenance allowance yet it is not sufficient to cater with daily needs of minors; that the lower Appellate Court has failed to consider the fact that one minor is serious patient of knee joints who needs proper medication and treatment for which monthly expenses at higher rate are required while the other minor is studying in PAF College, he, too, is in dire need of his educational expenses; that the Petitioner belongs to a rich family and he can easily pay more maintenance to his children.
7. I have heard the arguments of learned counsel for the parties and perused the record.

It is an established principle that findings on fact recorded by a competent court in exercise of lawful jurisdiction cannot be agitated by invoking writ jurisdiction under Article 199 of the Constitution of Islamic Republic of Pakistan, 1973 unless the same suffer from any legal infirmity, jurisdictional error or perversity causing serious miscarriage of justice.
9. Plea of the Petitioner is that the Courts below have awarded maintenance allowance at exorbitant rate which he is unable to pay. While the stance of the Respondents is that the Petitioner has strong financial status, who earns handsome income and can easily pay maintenance allowance as prayed for.
10. Admittedly a suit for dissolution of marriage on the basis of khulla and maintenance allowance was filed by the Respondents on 17.12.2016. The Petitioner entered appearance and filed written statement on 27.01.2017. The Family Court keeping in view the evidence of the parties, decreed the suit vide judgment and decree dated 25.04.2018 by awarding maintenance allowance to the minors @ Rs.10,000/- per month with 10% increase till their age of majority while the claim of the Respondents with regard to dowry articles to the tune of Rs.2,00,000/- as alternate price was allowed. The said Respondent was also held entitled to recover maintenance allowance @ Rs.30,000/- lumpsum for her iddate period only. The aforesaid judgment and decree was challenged by both the parties through separate appeals which was decided through consolidated judgment and decree dated 01.09.2018 whereby quantum of maintenance allowance was enhanced from Rs.10,000/- per month to Rs.15,000/- per month while remaining findings of the Family Court were upheld.

So far as the ground of the Petitioner with regard to fixation of maintenance allowance at higher side is concerned, it is an admitted position that the Petitioner is a MBBS doctor by profession and during cross examination he admitted that he has not annexed any document with regard to his income with written statement. It is noted that the Petitioner had ample opportunity to prove his financial status even at documentary stage and till decision of the suit but not only he, rather his witness, failed to do so which is clear violation of Section 9 of the Act. Evidence produced by the Petitioner depicts that he had concealed his sources of income from the stage of filing written statement till decision of lower appellate Court and there existed contradictions in the statements on behalf of Petitioner and his father, who was a witness, regarding source of income. The Petitioner appeared as DW-1 and admitted in his affidavit Ex.D1 that he earns Rs.30,000/- per month, for which he has not brought any salary slip to controvert the stance of the Respondents while on the other hand the father of the Petitioner appeared as DW-2 and deposed that the Petitioner pays maintenance allowance after lending money from his brothers and sisters. These contradictions on behalf of the Petitioner and his father clearly reflect the fact that the Petitioner has deliberately hidden his source of income from the Court just to avoid the payment of maintenance allowance to the minors. The Hon’ble Supreme Court of Pakistan in the case reported as "Muhammad Asim versus Mst. Samro Begum and others" (PLD 2018 SC 819) has held that “if the husband/father fails to disclose his salary or financial earnings, adverse inference would be drawn against him”. ‘Maintenance’ means and includes food, clothing, and lodging which is the responsibility of the father to pay to his children and wife. In this regard, it is noted that Section 17(A) of the Act specifically provides in sub-section to fix maintenance. The Honorable Supreme Court of Pakistan has considered the aforesaid issue in the case of “Humayun Hassan versus Arslan Humayun and another” (PLD 2013 SC 557) and held as under:
“Again in interpreting the word “maintenance” some reasonable standard must be adopted. Whilst it is not confined merely to food, clothing, and lodging, it cannot, by any stretch of the imagination, be extended to incorporate within its education at higher levels ad infinitum. What is necessary to decide in this connection is to find out as to what amount of education has to be attained by the child concerned, having regard to the status and other circumstances of his family, to enable it to earn a complete livelihood by honest and decent means. Thus it may not be sufficient to say that the child of a tradesman can maintain itself by working as coolly or by thieving. What is required is that the child must be maintained until it is in a position to earn its livelihood, in an honest ad decent manner in keeping with its family status.
12. Under the law, a father is bound to maintain his children until they have attained the age of majority. The intent and purpose of the maintenance allowance to a minor child is to enable her/him to continue living at least in the same state of affairs as the child was used to live prior to separation/divorce amongst the parents and it would be quite unjust and against the norms of proprietary if due to separation amongst the parents the child has to relegate to a lower level of living standard or he/she is declined the level or standard of education which was achieved by him/her prior to such happening i.e. separation of parents which admittedly has already taken place between the parties. At the same time, there is no escape from the fact that financial status of the father is also to be taken into consideration while awarding maintenance. The minors are entitled to be maintained by the father in the manner befitting the status and financial condition of the father and for this reason the Family Court is under an obligation while granting the maintenance allowance, to keep in mind the financial condition and status of the father. The Courts are under legal obligation to make an inquiry in this regard. It cannot act arbitrarily or whimsically. But in this case, the Petitioner has deliberately concealed his financial status regardless of admitted fact that he is MBBS doctor by profession and runs a clinic.

The learned lower Appellate Court, while considering the evidence and needs of the minors, enhanced the maintenance allowance as no documentary proof was produced by the Petitioner before it, therefore, keeping in view the evidence and basic needs of minors, monthly maintenance allowance for minors was enhanced to
Rs.15,000/- per month with 10% annual increase. As far as the question of recovery of dowry articles is concerned, after taking into consideration the oral, as well as, documentary evidence of the parties, and while applying the concept of wear and tear, learned Family Court held that the Respondent No.1 is entitled to receive her dowry articles as per list provided as Ex.P3 except articles mentioned at Sr. Nos. 9, 12 to 14, 17, 18, 23 to 28, 30, 33, 35 and 36 and in the alternate, the price of the same was fixed as Rs.2,00,000/- which finding was upheld by the lower Appellate Court.

So far as the stance of the Respondents with regard to enhancement of maintenance allowance of minors is concerned, it evinces from the record that the Respondent No.3 has failed to bring on record any document to prove income of the Petitioner as alleged. Resultantly, the Family Court keeping in view the basic necessities of life of minors and in view of the available record, granted maintenance allowance to them @ Rs.10,000/- per month which was further enhanced by the lower Appellate Court @ Rs.15000/- per month with 10% annual increase till their age of majority.
15. In view of above reasons, both the parties have failed to make out their case in any manner for interference in the findings of fact of the Courts below which is based on oral as well as documentary evidence produced by the parties. Resultantly, both the captioned writ petitions having no merits are hereby dismissed.

 It is settled rule that the paramount consideration in the matter being the welfare of the minors when examining the question of custody, the real mother of the child is the pristine source of unconditional love and affection which nature has put into her heart for her children and for which there could be no other substitute. Daughters require company and association of their real mother for preparing their personalities to shoulder the responsibilities in the future. Welfare of the minors would of course play a pivotal role in determining the controversy in hand i.e. question of custody. The cumulative effect of the available evidence leads to the ineluctable conclusion that the welfare of the minors in this case lies with the mother Mst. Alia Sehar. Furthermore the respondent admitted in cross examination that pursuant to the previous settlement qua regular visitation of the minors with their father, the respondent was duly availing this arrangement. Considering all these factors it is observed that the custody of the minors with their mother who is an educated lady and is living with her mother in a joint family system with the maternal grandmother also around will be in the best interest and welfare of the minors.

وٹتے رشتے اور فیملی کورٹس کا کردار

دنیا بھر کی طرح پاکستان بھر میں طلاق کا رجحان بہت زیادہ بڑھ گیا ہے، جس کی بنیادی وجوہات اعتماد اور ذہنی ہم آہنگی کا فقدان، معاشی مسائل اور عدم برداشت ہیں۔ طلاق جسے کسی دور میں ایک قابل نفرت عمل سمجھا جاتا تھا، اب ایک فیشن بن کر ہمارے خاندانی نظام کی جڑیں کھو کھلی کر رہا ہے۔ چھوٹی چھوٹی باتوں سے شروع ہونے والے اختلافات غصے ، غلط فہمی اور جلد بازی کے باعث گھر اجڑنے پر ختم ہو رہے ہیں جس سے معاشرے میں بے پناہ مسائل جنم لے رہے ہیں، خاندانی نظام جو مشرق کا حسن تھا اسے بڑی تیزی سے گھن لگتا جا رہا ہے۔ طلاق سے ٹوٹنے والے رشتے سے صرف دو افرا د ہی نہیں بلکہ ا ن کے بچے اور دونوں خاندان متاثر ہوتے ہیں۔
فاضل جج صاحبان کا اچھا اقدام ہے کہ میاں بیوی کو باہمی اختلا فات حل کرنے کا بھر پور موقع دیتے ہیںفیملی کورٹس کمپلیکس سرگودھا کی عمارت کا اندرونی منظر انتہائی جاذب نظر ہے ،کمپلیکس میں آویزاں پینٹنگزمیں طلاق کے بعدبچوں پہ گزرنے والے تکلیف دہ مناظر کو انتہائی مہارت سے پیش کیا گیا ہے
ملک بھر کی عدالتوں میں اس وقت بھی فیملی مقدمات کی بھر مار ہے، خاندانی جھگڑوں کی وجہ سے اب تک لاکھوں خاندان برباد ہوچکے ہیں۔ یہ جھگڑے جب خاندانی اور پنچائیتی سطح پر حل نہیں ہو پاتے تو بات عدالتوں تک پہنچ جاتی ہے اور اکثر اوقات قصہ علیحدگی پر ہی ختم ہوتا ہے، ستم ظریفی یہ ہے کہ اس سماجی اور معاشرتی مسئلے کے حل میں نہ تو کسی حکومتی ادارے کو دلچسپی ہے اور نہ ہی کسی سیاسی اور سماجی تنظیم کو؟ یہاں یہ کہنا بھی بیجا نہ ہو گا کہ باہمی محبت اوربرداشت میں کمی بھی اس کی سب سے بڑی وجہ ہے اور ٹی وی ڈرامے جس طرح میاں بیوی کے اختلافات کو ہوا دیتے ہیں اور ان کی بنیاد پر کہانیاں لکھی جا رہی ہیں یہ بھی بگاڑ کی بہت بڑی وجہ ہیں۔ایسے میں کہیں سے ہوا کاخوشگوار جھونکا آ ئے تو دل و جان معطر ہو جاتے ہیں۔
جی ہاں !بار ایسو یسی ایشن کی گہما گہمی میں سینئر وکلاء سے نئے فیملی کورٹس کمپلیکس سرگودھا کی تعریف سن کر نا صرف حیرت ہوئی بلکہ عرصہ سے فیملی جھگڑوں کے جلد اور منصفانہ حل کی جو خواہش ایک عرصہ سے دل میں چھپی ہو ئی تھی اچانک ابھر کر سامنے آ گئی، جم خانہ کلب سے نکل کر براستہ پل کچہری کی طرف جاتے ہوئے جوڈیشل کمپلیکس کی پر شکوہ اور خوبصورت سبزہ زار کے ساتھ ایک نئی تعمیر شدہ عمارت کا دلکش منظر متاثر کن تھا۔ فیملی کورٹس کمپلیکس کے مین دروازے کے دائیں طرف ایک خوبصورت فریم میں معصوم بچوں کی طرف سے عمارت کے افتتاح کی تصویر نصب تھی جو عمارت کے مقاصد کی نشاندہی کر رہی تھی ۔شاید یہ پہلی عمارت ہے جس کا افتتاح عدلیہ یا انتظامیہ کی کسی نامور شخصیت کی بجائے ان بچوں نے کیا ہے جو ماں باپ کے جھگڑوں کی بھینٹ چڑھ چکے ہیں۔ فیملی کورٹس کمپلیکس کی عمارت کا اندرونی منظر انتہائی جاذب نظر ہے ۔ کمپلیکس میں آویزاں ہر پینٹنگ ، یہاں کی ہر شے حتیٰ کہ در ودیوار بھی باتیں کرتے ہوئے محسوس ہوتے ہیں جو دیکھنے والے کے دل و دماغ میں احساس اور فکر مندی کی شمع روشن کرتے ہیں، میاں بیوی کی لڑائی ، دونوں کے درمیان علیحدگی اور طلاق کی صورت میں ننھے اور معصوم بچوں پر کیا گزرتی ہے اور میاں بیوی بذات خود پچھتاوے کی آگ میں کس طرح جھلستے ہیں ان تما م تکلیف دہ مناظر کو ان پینٹنگز میں اتنی فنکار انہ مہارت کے ساتھ سمویا گیا ہے کہ دیکھنے والے کی آنکھیں نم ہو جاتی ہیں اور ایک ایک پینٹنگ دیکھنے والے کے دل و دماغ میں دیر تک گھنٹیاں بجاتی رہتی ہے۔
کمپلیکس کا پورا ماحول انسان کو ان تما م پہلوؤں پر ایک نئے زاویے سے سوچنے پر مجبورکر دیتا ہے جس پر ہم اکثر سوچتے ہیں اور کسی مثبت حل کے متمنی ہوتے ہیں، ہم سلجھاؤ کے خواہشمند تو ہوتے ہیں لیکن کامیابی سے ہمکنار نہیں ہو پاتے۔
اللہ تعا لی نے انسان کو اپنا نائب اور اشرف المخلوقات بنایا لیکن اس حضر ت انسان نے چاند اور ستاروں پر تو کمندیں ڈال لیں مگر اکثر اوقات دلوں کو تسخیر کرنے میں بری طرح ناکام دکھائی دیتا ہے، چھوٹی باتیں بڑے بڑے طوفانوں کا پیش خیمہ ثابت ہوتی ہیں جس کے نتیجے میں پھولوں سے زیادہ نازک اور کلیوں سے زیادہ کومل ننھے اور معصوم بچوں کا مستقبل گردش زمانہ کی نذر ہو جاتا ہے، گھریلو جھگڑوں کی وجہ سے روزانہ کئی خاندان ذہنی اذیت سے دو چار ہوتے رہتے ہیں اور میاں بیوی کا جھگڑا بچوں کے مستقبل تاریک کر دیتا ہے۔ میاں بیوی کے درمیان ناچاقی اور روز روز کی لڑائی کے باعث معصوم بچے ایسے ذہنی کرب میں مبتلا رہتے ہیں کہ وہ عمر بھر کے لئے نفسیاتی مریض بن جاتے ہیں۔ طلاق کی صورت میں تو بچے دوراہے پر آجاتے ہیں۔ ماں بچوں کو اپنی
طر ف اور باپ اپنی جانب کھینچتا ہے۔ ایسے میں بچے تقسیم ہو کر رہ جاتے ہیں اور ساری زندگی ذہنی دباؤ کا شکار رہتے ہیں تو اس وقت سب کی امیدوں کا آخری سہارا فیملی جج ہوتا ہے۔ جب گھریلو جھگڑوں او ر مقدمہ بازی سے بچوں پر پڑنے ولے منفی اثرات کا شعور اجاگر کیا جاتا ہے تو فریقین سلجھاؤ کے آپشن کو خوش دلی سے قبول کر لیتے ہیں۔ فیملی کورٹس کمپلیکس سرگودھا کے قیام کے پیچھے ایک اعلیٰ سوچ کار فرما نظر آئی ہے کہ یہ صرف ایک عمارت نہیں بلکہ اس کمپلیکس میں واقع عدالتوں کے ججز بھرپور کوشش کر رہے ہیں کہ ان کے پاس دائر مقدمات میں فریقین کی صلح ہو جائے، جس کیلئے ججز فریقین کو پورا موقع دیتے ہیں اور ایسے فریقین جن کے بچے ہوں کو سمجھایا جاتا ہے کہ اپنے لئے نہیں تو اپنے بچوں کیلئے طلاق لینے اور دینے سے اجتناب کریں، فیملی کورٹس کے ججز کا سب سے اچھا اقدام یہ ہے کہ میاں بیوی کو قانون کے مطابق اپنے اختلا فات حل کرنے کا بھر پور موقع دیا جاتا ہے۔
فیملی ججز ان کے اختلافات دور کروانے کیلئے مصالحت اور ثالثی کے مروجہ طریقہ کار اختیار کرتے ہیں اور ہر ممکن کوشش کرتے ہیں کہ نہ تو بچوں کو والدین سے محروم ہونا پڑے اور نہ میاں بیوی میں جدائی ہو۔ طلاق کی شرح کم کرنے کے لئے فیملی کورٹس سرگودھا کے ججز انسانی ہمدردی کے جذبے کے تحت مصالحانہ کردار کے ذریعے خاندان کو ٹوٹنے سے بچانے اور معصوم بچوں کو عمر بھر کے ذہنی کرب اور احساس محرومی سے محفوظ رکھنے کیلئے بھر پور کوشش کر رہے ہیں۔
فیملی کورٹس کا ڈیکورم نہایت متاثر کن ہے اور کورٹس کے عملہ کے کمروں میں نظم وضبط دیکھ کر ایک عجب قسم کی سرشاری کا احساس ہوتا ہے۔ یہ فیملی کمپلیکس اس لحاظ سے بھی منفرد ہے کہ پنجاب میں پہلی دفعہ ان عدالتوں میں مقدمات کی سماعت کیلئے وقت مقرر کر دیا جاتا ہے جس سے نہ صرف فریقین بلکہ مقدمے کے وکلا کو بھی بروقت پیش ہونے میں سہولت رہتی ہے اور فریقین انتظار کی کوفت سے بچ جاتے ہیں۔ مصالحت کا جدید طریقہ کار اپناتے ہوئے فیملی ججز مقدمات کے میرٹ پر فیصلے کو یقینی بنارہے ہیں جس سے فریقین نگرانی کے اخراجات اور کوفت سے بھی بچ رہے ہیں۔ باپ کے مالی معاملات اور جائیداد چھپانے کی صورت میں عدالت عالیہ اور عدالت عظمیٰ کے فیصلہ جات کی روشنی میں ان کی مالی حیثیت کے تعین کیلئے عدالت جدید سائنسی ذرائع سے شہادت اکٹھی کرتی ہے، دیکھنے میں آیا کہ جن بچوں کا خرچہ فکس ہو جاتا ہے،
ان کو رقم بینک اکائونٹس، منی آرڈر اور دیگر جدید ذرائع سے ٹرانسفر کرانے کی طرف لوگوں کو مائل کیا جا رہا ہے تا کہ سائلین کو عدالتوں کے چکر لگانے اور وقت کے ضیاع سے نجات مل سکے، جبکہ جہیز کے سامان کی واپسی کیلئے یہ عدالتیں فریقین کی باہمی مشاورت سے بیلف مقرر کر کے تسلیم شدہ سامان کی بروقت واپسی یقینی بنا رہی ہیں۔ فریقین کو اس بات کا احساس دلایا جاتا ہے کہ ان کی علیحدگی کے باوجود بچے کو ماں اور باپ دونوں کی ضرورت ہے اور کسی ایک کی کمی بچے کی نفسیات اور کردار پر منفی اثرات مرتب کر ے گی۔ فریقین کو عدالتی کمپلیکس کے بجائے گھر پر ملاقات کے فوائد و ثمرات سے آگاہ کیا جاتاہے جبکہ یہ بات بھی دیکھنے میں آئی کہ ماں باپ سے علیحدہ ہونے والے بچوں کے مقدمات کیلئے فریقین کو ماں، باپ کسی رشتہ دار یا دوست احباب جس پر فریقین کو اعتماد ہو یا فریقین متفق ہوں کے ذریعے ان کے ہاں ملاقات کرانے پر قائل کیا جاتا ہے۔
فیملی کورٹس کمپلیکس سرگودھا کے در و دیوار پر آویزاں پینٹنگز آنے والے سائلین کو اہم نوعیت کا پیغام دیتی ہیں ۔طلاق کا دعویٰ کرنے والی کئی پڑھی لکھی خواتین ان تصاویر سے متاثر ہو کر اپنے شوہروں سے صلح کر کے بچوں کے ساتھ خوش و خرم آباد ہو چکی ہیں، اس فیملی کورٹس کمپلیکس کی وجہ سے 2021 کی نسبت 2022 میں طلاق کی شرح میں بڑی حد تک کمی دیکھنے میں آئی ہے، جبکہ سال رواں 2023 میں اب تک یہاں پانچ عدالتوں میں چلنے والے طلاق کے کیسز میں تا دم تحریر ایک بھی طلاق نہیں ہوئی جو اس بات کی واضح دلیل ہے کہ پنجاب بھر کی فیملی کورٹس کو مصالحت اور ثالثی کے مروجہ اقدامات پر عمل کرنے کی اشد ضرورت ہے، اگر ملک بھر کی فیملی کورٹس اسی طریقہ کار کے مطابق کام کرنا شروع ہو جائیں تو یہ بات دعوے سے کہی جا سکتی ہے کہ ملک میں طلاق کی شرح میں بڑی حد تک کمی واقع ہو سکتی ہے، جس سے لوگوں کے گھر اور خاندان اجڑنے سے بچ سکتے ہیں۔اگر ایسا ہو جائے تو نا صرف خاندان اجڑنے بچ جائیں گے بلکہ طلاق کے نتیجہ میں پیدا ہونے والی دشمنیوں میں بھی کمی واقع ہو جائے گی اور حکومت اور اعلیٰ عدلیہ کو عوام اور ملک کی بہتری کیلئے فیملی کورٹس کمپلیکس سرگودھا کی طرز پر فیملی مقدمات کے حل پر توجہ دینے کی ضرورت ہے۔

Presumption of the delivery of Dowry articles attached to rukhsati---In an arranged marriage and in line with customs which are deeply rooted and entrenched in the society, parents whether rich or poor always give Dowry to their daughters at the time of marriage, so delivery of Dowry articles can be presumed if Rukhsati takes place

Presumptions as to large family and a Pathan family are gratuitous/legally unwarranted and hence anathema--- No constitutional/statutory dispensation in force recognizes such presumptions to defeat the return of Dowry articles---In presence of the fact that Rukhsati took place, the delivery of Dowry articles ought to have been presumed as per law

S. 5, Sched.--- Dowry --- Suit for recovery of past/future maintenance, delivery expenses and return of Dowry articles---Petitioner/wife alleged that due to the cruelty of respondent/husband she was compelled to leave his place and live with her parents where minor daughter was born---Petitioners' suit was partially decreed entitling wife to receive maintenance for her Iddat period only and delivery expenses, and minor was awarded past and future maintenance allowance since her birth---Petitioner's claim for past maintenance and return of Dowry articles was concurrently dismissed in totality---Held, that for proving herself entitled to the recovery of past maintenance, petitioner could not prove the fact that she had been compelled to leave the house of respondent on account of cruelty---While rejecting the petitioner's claim as to return of Dowry articles Trial Court observed that since petitioner was twelve siblings, Dowry articles could not have been given to her by her parents---Such observation of the Trial Court was questionable/unwarranted and having no basis in law---If Rukhsati took place (and which did take place) then giving of Dowry articles was presumed which was also trite and acknowledged---Petitioner had specifically taken the plea about Dowry articles and had relied on a list filed along with her plaint pertaining to Dowry articles valuing Rs.4,23,526/- to be recovered---Petitioner also appeared as witness and her testimony could not be shattered as such during cross-examination---Appellate court committed the cardinal mistake of basing its decision on a questionable/bald presumption that 'Pathan' families would not give Dowry articles to their daughters'---No legal benchmark/yardstick existed which explained that Pathans would not give Dowry articles to their daughters---Such was an absolutely irrelevant consideration---Trial Court did not attach any importance to the deposition of petitioner and her father as to purchasing of Dowry articles and brushed aside without much ado---High Court partially allowed the Constitutional petition and deemed the question of return of Dowry articles pending before Family Court and directed that the same to be decided in view of evidence on record and not on the basis of said presumptions
