چھوٹے بچوں کی تحویل حقیقی والدین کو دی گئی، اپنائے گئے والدین کے مقابلے میں۔

یہ بات واضح ہے کہ اسلامی قانون کے اصولوں کے تحت گود لینے کی اجازت ہے، لیکن اس کے لیے ایسے مجبور کن حالات کا قیام ضروری ہے جن کے تحت گود لینے کی ضرورت پیش آئی۔ یہ بات اچھی طرح سے طے شدہ ہے کہ حقیقی والدین کو اپنے بچے کی تحویل کے حوالے سے ترجیحی حق حاصل ہے، جب تک کہ بچے کی فلاح و بہبود اس کے خلاف نہ ہو۔

اس کیس کے حقائق بھی پاکستان میں گود لینے کے حوالے سے کسی بھی قانونی انتظام کی عدم موجودگی اور گود لینے کے قانون کو منظم کرنے کی ضرورت کو اجاگر کرتے ہیں۔ ایسے بے شمار کیسز ہو سکتے ہیں جہاں گود لینے کی ضرورت ہو، لہذا یہ ضروری ہے کہ قانون ساز ادارہ ایک ایسا قانون نافذ کرے جو ان حالات کی وضاحت کرے جن کے تحت بچے کو گود لیا جا سکتا ہے، گود لینے کا طریقہ کار اور گود لیے گئے بچے اور تحویل رکھنے والے والدین کے حقوق اور ذمہ داریوں کی وضاحت کرے تاکہ گود لینے کے حوالے سے سوالات کو منظم اور فیصلہ کیا جا سکے۔ پی ڈی این سی ایکٹ اس مقصد کو حاصل کرنے میں ناکام ہے کیونکہ اس کا دائرہ محدود ہے۔

دفتر کو ہدایت کی جاتی ہے کہ اس فیصلے کی تصدیق شدہ کاپی سیکرٹری، قانون و پارلیمانی امور، حکومت پنجاب کو بھیجے تاکہ گود لینے کے موضوع پر مناسب قانون سازی کے عمل کا آغاز کیا جا سکے۔

Custody of minor conferred to real parents in the wake of contest by adopted parent.

There is no cavil to the proposition that adoption is permitted under the principles of Islamic Law but compelling circumstances under which adoption was necessary are required to be established. It is well settled that Real Parents have preferential right qua custody of their child unless the welfare of the child demands otherwise.

The facts of this case also underscore absence of any statutory dispensation qua adoption in Pakistan and corresponding need for regulating the law of adoption. There may be innumerable cases where adoption is imperative, therefore, it is necessary that a law is promulgated by the legislature spelling out the circumstances under which adoption of a child can take place, the procedure for adoption and the rights and obligations of the adopted child and the custodial parents so that questions regarding adoption can be regulated and adjudged, accordingly. The PD&NC Act falls short to achieve this objective due to its limited scope.

Office is directed to transmit a certified copy of this Judgment to the Secretary, Law & Parliamentary Affairs, Government of the Punjab for consideration and initiation of process of appropriate legislation on the subject of adoption.
