Legitimacy of child---Proof---Petitioner / plaintiff denied any relationship with respondent / defendant and sought jactitation of marriage and also denied minor to be his son---During proceedings, application of petitioner / plaintiff was dismissed by Family Court and Lower Appellate Court declining to de-exhibit documents produced by respondent /defendant---Validity---Decree for jactitation of marriage did not automatically render a child illegitimate and presumption of legitimacy remained intact unless rebutted by proper evidence---If a paternity suit had been pending before Civil Court, the Family Court's best course would have been to stay proceedings in both the suits until the Civil Court rendered its decision, which option was unavailable---Family Court could also have sought consent of parties to stay proceedings until the petitioner / plaintiff could approach Civil Court for adjudication of minor's paternity---Respondent / defendant previously filed a civil suit but she withdrew it and under O.XXIII, R.1 (3), C.P.C., thus, she was precluded from refiling a suit on same cause of action---High Court directed that if the parties did not consent or petitioner / plaintiff failed to initiate such proceedings within stipulated period, Family Court would proceed with consolidated suits deciding only on jactitation of marriage and dissolution without making any findings on paternity---Minor son was not party to any suit before Family, Court and decree issued could not bind him regarding paternity---
